Traders’ ban bid rejected

A street market of covered stalls will finally appear in Commercial Street and High Town in Hereford, after a High Court judge overturned an injunction to stop its planned opening.

The market opening will now take place at 10.30am on Saturday, July 25, a month later than planned after traders at the Butter Market got a judge to stop it  with an injunction.

The Butter Market’s Independent Traders Association, and its chairman Len Tawn, stopped the street market from opening as planned for June 27, but on Monday a High Court Judge gave it the green light.

He refused a traders’ request for a judicial review as well as their leave to appeal.

He ruled that the market traders had a right to object to the street market, adding that there had been consultation, and there is no basis for impugning the decision on the grounds of procedural impropriety.
